General information on the Legal Guarantee.
Each product sold by BSA to a "consumer" buyer is covered by the legal guarantee on consumer goods, which covers conformity defects that appear within 24 months from the date of delivery of the goods.
What is the legal guarantee?
This is the guarantee on the sale of consumer goods provided for by the Community Directive 1999/44 / EC, also called "guarantee of conformity", which protects you in the event that the products you purchase show lack of conformity with respect to the sales contract ("Guarantee Legal").
This happens, for example, in the case of products that work poorly, which cannot be used in the manner declared by the seller or for the purposes for which products of the same type are generally used, which do not have the characteristics or qualities promised by the seller or that do not respond to the use for which you purchased them.

What is the duration of the Legal Guarantee?
The Legal Guarantee covers conformity defects that appear within 24 months from the delivery date of the product you purchased, even if the defect was not immediately detectable on that date. To assert it, you must notify the seller of the defect within 2 months from when you discovered it.
Unless proven otherwise, it is assumed that the lack of conformity that occurs within the first 6 months from the date of delivery of the goods already existed on that date, unless this hypothesis is incompatible with the nature of the goods or with the nature of the defect of compliance.
We recommend that you always keep the purchase receipt that you find in the product packaging, as well as the documents confirming the shipment and delivery of the product.
Am I entitled to the Legal Guarantee?
The Legal Guarantee is entitled only to the consumer, that is, to those who purchase products for non-professional purposes. For example, if you buy a laptop exclusively for your personal use, you are entitled to the Legal Guarantee. On the contrary, if you buy it to use it in your work, the Legal Guarantee does not apply.
Against whom can I enforce the Legal Guarantee?
If you are a consumer you can enforce the Legal Guarantee against whoever sold you the product, even if it is a person other than the manufacturer. BSA is therefore liable for products purchased from BSA. For products sold by third parties, the Legal Guarantee is borne by the seller and BSA has no responsibility in this regard.
What rights does the Legal Guarantee give me?
If the product you have purchased has a defect covered by the Legal Guarantee, you are entitled, without incurring any expense, to the repair or replacement of the defective product by the seller. You are entitled to a price reduction or termination of the contract in the following cases: (a) if the replacement or repair of the product is not possible or is excessively onerous; (b) if the seller has neither repaired nor replaced the product within a reasonable period of time; or (c) if the replacement or repair of the product has caused you significant inconvenience. To determine the amount of the price reduction or the amount you are entitled to in these cases, the use you have made of the product is taken into account. Keep in mind that a minor defect for which it has not been possible or is excessively burdensome to carry out the remedies for repair or replacement does not give the right to terminate the contract.
What to do in the presence of a lack of conformity?
To receive warranty assistance on products sold by BSA you can contact Customer Service by contacting us.
The operators of our Customer Service will help you to solve the problem encountered in using the product you have purchased.
If it emerges that the problem derives from a lack of conformity, a case will be opened in your name and you will be assigned a code for the repair or free replacement of the defective product under warranty.
Please note that, in the event of a replacement, we will deliver the replacement product to you within a reasonable time and you will be required to return the non-compliant product to us within 30 days from the date you received our notification of the replacement product.
Right of withdrawal
BSA is particularly attentive to the needs and expectations of its customers. We hope you are always happy with your purchases from BSA, but if you change your mind, here we explain what you can do to return an item.
The right of withdrawal
If you are a consumer, you can exercise the right of withdrawal, i.e. decide to return the item to the seller without giving any reasons, within 14 calendar days of delivery (or of the delivery of the last item, in case of separate deliveries).
In addition to your rights under the law (Legislative Decree 206/2005), items sold by BSA and third party sellers through BSA (except for products for which the right of withdrawal is excluded by law) may be returned within 30 days of delivery.
Items excluded from the right of withdrawal
The right of withdrawal may be exercised in relation to any product purchased from BSA (both those sold by BSA and by third party sellers through BSA), with the exception of:
- items made to measure or clearly personalized or which risk deteriorating or expiring rapidly,
- sealed items that cannot be returned for hygienic reasons or related to health protection and that have been opened after delivery or in the case of products that are, after delivery, inseparably mixed with other goods,
- supply of alcoholic beverages, the price of which has been agreed upon at the time of conclusion of the sales contract, whose delivery can only take place after thirty days and whose actual value depends on market fluctuations that cannot be controlled by BSA,
- audiovisual products (eg music compilations, films) and software (eg programs, video games), on CDs, DVDs or other media, whose packaging has been opened or the relative seals have been removed,
- newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications,
- digital content (for example, e-books, mp3s, applications or other digital content redeemable through promotional codes) provided through a non-material support once execution has begun. By placing an order for the purchase of such digital content, you agree to the foregoing.
To exercise the right of withdrawal
If the item was sold by BSA or sold by a third party seller through BSA and shipped by BSA
The product must be returned in the same condition in which it was received, in the original unopened packaging and where present, the manufacturer's seal must not have been removed. Otherwise we reserve the right not to accept the return or to offer a partial refund by agreement with the customer as the product can no longer be sold as new.

Refund in case of withdrawal
If you purchase as a "consumer" and withdraw within 14 days of delivery, you will be refunded the price paid for the item and the shipping costs for the cheapest shipping method available at the time of the order. The costs of gift wrapping and other services associated with your order will not be refunded in case of withdrawal. For more information on shipping costs contact us. For shipping costs applied by third party sellers, contact the third party seller, if you need support contact BSA.
However, if you cancel after the 14 calendar day deadline in accordance with BSA's return policy, or if you purchase as a "professional", you will be refunded the price of the item, but not the shipping costs.
If the returned items show damage or signs of wear resulting from unnecessary manipulation to establish the nature, characteristics and functioning of the same, the seller may withhold from the refund an amount corresponding to their decrease in value.
We remind you that in the event of withdrawal, the costs for returning the item (eg shipping and packaging) are at your expense.
Refund timing
The refund of the price of the item for which the withdrawal has been exercised and, where applicable, of the shipping costs, is made within 14 days of receipt of your notice of withdrawal. The seller can withhold the refund until the item is received or until you have provided proof that you have returned it, whichever comes first.

BSA anti-counterfeiting policy
The products sold on BSA must be authentic. It is strictly forbidden to sell counterfeit products. Failure to comply with this policy may result in the revocation of selling privileges, freezing of funds and destruction of products stored at our fulfillment centers.
It is the responsibility of each seller and supplier to buy, sell and manage only authentic products. Prohibited products include illegal copies and pirated copies of products or content, counterfeit items, illegally replicated, reproduced or manufactured products, products that infringe the intellectual property rights of other parties. Sellers and suppliers of non-authentic products will incur in the suspension or removal of the BSA sales account (and any related accounts). BSA also reserves the right to destroy any unauthentic product stored in its logistics centers at the seller's expense. BSA pays sales revenues to sellers only after verifying that the products ordered by customers are authentic. BSA reserves the right to withhold a payment in the event that the Seller account has been used to sell counterfeit products, commit fraud or carry out other illegal activities.
BSA works with manufacturers, rights holders, content owners, suppliers and vendors to improve verification processes aimed at preventing the sale of counterfeit products. For this purpose, all offers that are suspicious after our checks will be removed. We also work with rights holders and law enforcement agencies around the world to take legal action against vendors and suppliers who deliberately violate our policy to the detriment of customers. Sellers and suppliers of inauthentic products may incur civil penalties, including loss of any gains from the sale of inauthentic products, compensation for damages suffered by rightholders, damages for statutory purposes and any other damages, as well as legal fees. In some cases, failure to comply with our anti-counterfeiting policy is punishable by criminal penalties up to imprisonment.
We will investigate the issue and promptly take all necessary steps to protect customers, sellers and rights holders.

Provided that you comply with these General Conditions of Use, the Terms of Service, and that you pay any applicable fees, BSA or its content provider grants you a limited, non-exclusive, non-transferable and non-sublicensable license. to access our services and make personal and non-commercial use of them. YOUR ACCOUNT
You may need your BSA account to use certain of our services and be required to log into your account and have a valid payment method associated with it.
If there is a problem charging your selected payment method, we may charge any other valid payment method associated with your account.
If you use our services, you are required to keep your account and password confidential and to control access to your computer and devices, and agree, to the extent permitted by applicable law, to be held responsible for all activities that will be carried out with your account and password. BSA SOFTWARE TERMS
In addition to these General Conditions of Use, the software (including any updates / upgrades and related documentation) that we make available to you from time to time in relation to our services is subject to the specific service terms.
THIRD PARTY ACTIVITIES
Entities other than BSA operate shops, provide services or sell product lines on some of our sites. We also provide links to affiliate company sites and other businesses. We are not responsible for the control or evaluation of these commercial operators or subjects or the content of their sites, nor do we offer guarantees on their sales proposals. BSA cannot in any way be held responsible for the actions, products and contents of all these parties or any third party. THE ROLE OF BSA
BSA allows third party vendors to list their products on through BSA. In the detail pages of each product it is indicated whether the product is sold by third parties or in the case of direct purchase you will be notified before any confirmation from you. As the provider of the e-commerce site, BSA facilitates transactions on the site, but is not part of the contract for the sale of the goods sold by these third party sellers. OUR LIABILITY

BSA will not be liable for (i) losses that are not a consequence of our breach of these general conditions or (ii) for any loss of business opportunity (including lost profits, revenues, contracts, anticipated savings, data, goodwill or unnecessarily incurred expenses) or (iii) any other indirect or consequential losses that were not reasonably foreseeable, either by you or by us, at the time you started using our services.
We will not be responsible for any delay or failure to comply with the obligations set out in these general conditions if the delay or failure derives from unforeseeable circumstances or due to force majeure. This provision does not affect your rights deriving from the law and in particular your right to receive the goods purchased within a reasonable time or to be reimbursed in the event of non-delivery due to circumstances arising from unforeseeable circumstances or due to force majeure. The legal provisions in force in some states may prohibit the limitations of liability indicated above. In the event that these provisions are applicable, the limitations of liability indicated above will have no effect and further rights may be recognized. APPLICABLE LAW AND JURISDICTION
These General Conditions of Use are governed by and must be interpreted in accordance with Italian law (with the exception of the provisions on conflict of laws) and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. . WAIVER

MINORS
BSA does not sell products and services to minors. We sell children's products that can only be purchased by adults. If you are under the age of 18, you can only use our services with the involvement of a parent or guardian. If you believe your intellectual property rights have been infringed, you can contact us. We respond promptly to intellectual property rights holders who provide us with the complete information necessary to process the request and the assessment of the case.
By contacting us you also grant BSA the right to use, reproduce, modify, adapt, publish, translate, create derivative works and show the contents of the same Notification Form anywhere in the world by any means of communication. ADDITIONAL TERMS FOR THE BSA SOFTWARE
- Use of BSA software. You may use the BSA Software only for the purpose of using our services within the limits of the General Conditions of Use, these Additional Terms for the BSA Software and the Terms of Service. You may not incorporate a portion of the BSA Software into your programs or compile portions thereof in combination with your programs, you may not transfer the BSA Software for use in connection with another service, or sell, rent or lease, distribute or lease sub-license, or otherwise assign any rights in the BSA Software in whole or in part. You will not be able to use the BSA Software for illegal purposes. We may cease supplying the BSA Software and may revoke your right to use the BSA Software at any time. Your right to use the BSA Software will be automatically revoked, without any prior notice from us, in the event of your breach of the provisions of these Additional Terms for the BSA Software, the General Conditions of Use or the Terms of Service. The BSA Software may be subject to the application of additional third party terms and conditions, contained or distributed in conjunction with certain BSA Software (or software incorporated into the BSA Software) indicated in its documentation. These provisions will prevail in case of conflict with the General Conditions of Use. - Prohibition of "reverse engineering". You may not copy, modify, reverse engineer, decompile or disassemble or otherwise intervene on the BSA Software in whole or in part or create derivative works from or of the BSA Software, nor encourage, assist or support other objects to carry out such activities.
- In order to keep the BSA Software up to date, we may provide automatic or manual updates at any time and without notice.
We encourage you to read these terms carefully before using the BSA Services. By using the BSA Services, you fully accept these conditions.
GENERAL CONDITIONS OF SALE
These general conditions of sale govern the sale of products and, where applicable, of services through when BSA operates as a seller ("General Conditions of Sale"). The sale of products by third party sellers will be governed by the terms and conditions of sale applicable from time to time. OUR CONTRACT
The presentation of products and services on the site or through the BSA applications for mobile devices constitutes an invitation to offer.

PRICES AND AVAILABILITY
All prices are inclusive of VAT applicable by law.
The information on the availability of the products we sell is variable, contact us for information about it. Please consider that the estimated times for sending and delivering the products are purely indicative and it is not possible to fully rely on them. Once we have received your order, we will notify you by email if any of the products you have ordered are not available.

In any case, we will check the correctness of product prices during the order verification process and subsequent shipment of the products. CUSTOMS
Should the goods ordered by BSA be delivered outside Italy, you may be subject to import duties and taxes, payable once the package reaches the specified destination. Any additional customs clearance costs will be your responsibility. We are not in control of these costs and cannot predict the amount. Customs policies vary considerably from country to country and you should therefore contact your local customs office for more information. Please also bear in mind that when you place orders on the site or from us, you are considered an importer and are therefore required to comply with all laws and regulations of the country where you will receive the goods. WARRANTIES ON PRODUCTS SOLD BY BSA AND LIMITATIONS OF LIABILITY
The warranty regime on products sold by BSA differs according to whether the buyer is a "consumer" or a "professional" pursuant to Directive 1999/44 / EC concerning "certain aspects of sales contracts and guarantees concerning consumer goods ".
If you buy as a "consumer", you benefit from the legal guarantee of conformity which the seller is required by law on all goods sold ("Legal Guarantee").
The Legal Guarantee - to which BSA is held as a seller - guarantees the goods against conformity defects with respect to the sales contract.
Pursuant to the law, in case of applicability of the Legal Guarantee, you will be entitled to the restoration without expenses of the conformity of the goods by repair or replacement, or, if this is not possible, to a reduction in the purchase price or to the termination of the contract. BSA is therefore liable for lack of conformity if they occur within two years from the date of delivery of the goods. In any case, you will have the responsibility to report the lack of conformity within two months of its discovery.

Within the limits permitted by law, BSA declines all responsibility in the event that the delivered product does not comply with the legislation of the country of delivery other than Italy.
BSA will not be liable in case of delay in the delivery of purchased goods due to insufficient stocks at the publisher or supplier.
We will also not be liable in case of insuBSAantial differences between the purchased goods and their illustrative images and text descriptions published on our site.
Except in the case of willful misconduct or gross negligence, we are solely responsible for any direct and foreseeable damage at the time the sales contract is concluded. We will therefore not be liable for any losses suffered, loss of earnings or any other damage that is not an immediate and direct consequence of our non-fulfillment or that was not foreseeable at the time of the conclusion of the sales contract. BSA is in no way responsible for the fulfillment of the obligations borne by third parties who may offer commercial guarantees in relation to the products for sale on the site.

Each page of products displayed for sale on the bsa-store.com site indicates when the product is sold by third party sellers and not by BSA. As the provider of the e-commerce site, BSA facilitates transactions on the site, but is not part of the contract for the sale of the goods sold by these third party sellers. CHANGES TO THE GENERAL CONDITIONS OF SALE
